DC Circuit Court Makes Error In Noel Canning v. NLRB

The DC Circuit Court, a body that currently consists of Republican judges, made a decision in the case of Noel Canning v. NLRB siding with the plaintiff that President Obama's three recess appointments made on January 4th 2012 were invalid. The DC Circuit holds that the NLRB failed to explain what a recess was, and that the U.S. Senate was not in recess at the time Obama took the action. But in the DC Circuits written decision, it looked at every definition of the term "recess" but the correct one - the one that applies to the U.S. Senate.
